\nI knowingly, freely and voluntarily assume all responsibility for any damage or injury that may occur to me as a result of my participation in “Alligator The Race and Bike Fest 2025″, an event that will take place at Markham Park on Feb 22 and 23, 2025 in Broward\u00a0County.\u00a0 I agree to release, resign, terminate, and agree not to sue the event producer \u201cSantiago Perez Productions and\/ or Broward County and\/ or its current and former officers, agents, employees, and volunteers (collectively, the” Released “) from any liability or claim\u00a0 for the damages that may be suffered by me, the members of my family or companions, or any third party, directly or indirectly, together with or derived from my participation in the event.<\/span><\/p>\n

Sandbagging Policy:<\/span>
\nTo ensure fair competition, participants must register in the appropriate category based on their skill level, age, and previous race results. Race organizers reserve the right to reassign runners to a different category if evidence of sandbagging (intentionally competing in a category below their skill level) is discovered. Failure to comply may result in disqualification without refund.<\/span>
\nParticipants are encouraged to compete with integrity and respect the competitive spirit of the event.<\/span>
\nYou must complete your race before the start of the next race, otherwise, you have to drop out of the race or will be removed by staff.<\/span><\/p>\n

BROWARD COUNTY AND SANTIAGO PEREZ PRODUCTIONS INC<\/span>
\nNOTICE: This is a waiver of liability, assumption of risk, indemnification and release of liability (hereinafter the “Waiver”). Once you register, this Waiver will apply to any and all matters occurring at Alligator The Race and bike Fest on February 22 and 23, 2025 or within five (5) years thereafter. This Waiver is intended to be a legally binding document and upon registration, it has legal consequences for the participant and any minors previously registered. Please read this document carefully before signing.<\/span><\/p>\n

As consideration for Broward County, and Santiago Perez Productions offering the activity described above (the “Activity”) and allowing the individuals registered above to participate, the adult registered above (“Canceller”) freely makes the following representations, both individually and on behalf of the minors registered above:<\/span><\/p>\n

Releasor acknowledges and understands that the Activity is potentially dangerous and that there may be health and safety risks associated with the Activity. These risks include exposure to conditions that may result in bodily harm, injury, partial or total disability, paralysis, and\/or death. The potential hazards and dangers associated with the Activity include, but are not limited to, the following: risks and dangers caused by Releasor’s own action(s) or omission(s); risks and dangers caused by the Releasees named below; dangers of collision with other participants in the Activity or fixed or moving object(s); and dangers arising from surface hazards, equipment failure, safety equipment, or weather conditions. Releasor represents and warrants that Releasor and the referenced minors have no known health problems that would hinder, or be aggravated by, participation in the Activity and that participation in the Activity is purely voluntary.<\/span><\/p>\n

Releasor hereby releases, waives, discharges, and covenants not to sue Broward County and\/or\u00a0 its past, present, and future officers, agents, employees, and volunteers (collectively referred to as “Releasees”), \u00a0and\/ or Santiago Perez Productions Inc and\/ or \u00a0its past, present, and future officers, agents, employees, and volunteers (collectively referred to as “Releasees”), and\/ or Alligator The Race and\/ or its past, present, and future officers, agents, employees, and volunteers (collectively referred to as “Releasees”); for any and all liability, claims, or damages that may be sustained by Releasor or any of the minors referenced above arising out of or relating to the Activity, including, without limitation, claims for personal or bodily injury, property damage, or economic and noneconomic losses, even if any of the foregoing are caused in whole or in part by negligence of the Releasees. Further, Releasor hereby agrees to defend and indemnify Releasees for any claims, injuries, or damages of any kind or nature (including, without limitation, attorneys’ fees) asserted against any of the Releasees by a third party that arise from or relate to Releasor’s or any of the referenced minors’ participation in the Activity.<\/span><\/p>\n

If minors are identified above, Releasor represents and warrants that Releasor is the natural or legal guardian of such minors, or otherwise has legal authority to accept this Release on behalf of the minor(s). Releasor shall defend and indemnify Releasees for any liability, claims, or damages of any kind or nature (including, without limitation, attorneys’ fees) asserted against Releasees arising out of or relating to allegations that Releasor did not have legal authority to sign this Release on behalf of the minor(s).<\/span><\/p>\n

Releasor acknowledges and agrees that the representations and agreements contained herein are binding upon Releasor, individually and on behalf of any minors identified above, and are not merely recitals, and have been relied upon by Releasees prior to authorizing Releasor and any minors identified above to participate in the Activity.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"
